话说2004年修宪之前，中国在讨论是否要在宪法里写入私有财产权的保护条款，有位中国的政治学者就认为，当年洛克所说的财产estate在美国那里都被替换为pursuit of happiness，这个改动很重要，可以证明美国宪法制定的当时并不保障财产权。其实，这只能说明他不太熟悉美国宪法。因为《独立宣言》虽然是这样的，但到了此后的美国宪法文本，情况就变了：其第5条和第14条修正案都完整地采纳了洛克的分类，规定非经过正当法律程序，不得剥夺任何人的“生命、自由和财产”，只不过这里所说的财产，这下用的是property一词，而不是洛克当年所使用的estate。
马克思思想的一个难得的地方在于，他同情弱者。
针对这一点，我个人这几年做的唯一重要的工作就是一个国家社会科学规划课题，名字就叫《宪法审查的原理与技术》，先出这本书，60万字左右，紧跟着再出七本书，由我的七个博士生一人写一本，号称“七剑下天目山”，专门研究宪法（违宪）制度。我们呼吁宪法不能没有牙，强烈呼吁！

第三个特点是，<原文开始>立宪主义意义上的宪法被广泛认为体现了宪法最优异的特质。
那么，这种宪政的实质又是什么呢？…… 毛泽东有一个观点很著名，在我国影响很大。他认为，宪政就是民主政治。…… 宪政就是民主政治。成为此后我国的通说，迄今为止仍然是主流意识形态所认可的传统通说。…… 然而，根据国际通说，宪政的基础未必就是民主主义，而是立宪主义。
1789年法国《人权宣言》第16条做过一个非常经典的表述，其中写道：“权利的保障没有确保，权力分立没有定位的社会，即完全没有宪法。”这句话被国际宪法学界看作是对传统立宪主义精神的一种精确的表述,迄今为止仍然被奉为圭臬。
